These terms and conditions (“Conditions”) governs your use of SOLYPH.com (which shall include all purchases of merchandise or services (“Products”) on SOLYPH.com) and other interactive sites including SOLYPH Facebook page, Twitter, Instagram and YouTube (“Interactive Sites”). By accessing or using SOLYPH.com or the Interactive Sites, you are deemed to have agreed to be bound by these Conditions. If you do not agree to any part of these Conditions, please do not access or use SOLYPH.com or the Interactive Sites. Any continued access or use of SOLYPH.com or the Interactive Sites will imply that you have accepted these Conditions. SOLYPH reserves the right, at any time, to revise or update these Conditions without your prior notice. These changes will take effect immediately upon posting. By continuing to use SOLYPH.com or the Interactive Sites following such changes, you will be deemed to have agreed to such changes."

Merchandise Availability

The Products featured on SOLYPH.com are subject to stock availability. If the Products are not available after your order has been processed online, we will inform you via email.

Orders, Promotions & Samples

All our promotions and samples are subject to availability and our prevailing terms and conditions. Save for any errors, the prices of the Products displayed at the check-out are final and will be reflected on the website, any of SOLYPH's Social media platforms such as its Facebook and Instagram, and on its Order Confirmation. No other prices shall be applicable to the Products. While SOLYPH endeavours that all prices on SOLYPH.com are correct, errors may occur. If SOLYPH discover an error in the price of a Product you have ordered, SOLYPH will inform you as soon as possible and give you the option of proceeding with your Order at the correct price or cancelling it. If SOLYPH.com are unable to contact you, the Order will be treated as cancelled, and you will be refunded accordingly. SOLYPH.com gift cards, gift vouchers or any promotional vouchers cannot be used to offset online purchases on SOLYPH.com unless stated otherwise.

Cancellation of Orders

SOLYPH.com do not accept any cancellation or modification of Order once we have confirmed the Order. Hence, it is important that you check your order before proceeding with the payment. Notwithstanding that the Order has been accepted and confirmed, SOLYPH.com reserves the right to cancel the Order or any part thereof at any time without giving you any reasons. SOLYPH.com will inform you of any such cancellation via email and will refund you accordingly without interest. All refunds will be credited without interest into the same credit card that was used for the Order. Please note that it takes approximately 21 days for a credit return to your card to be effective.

Product Information

Please note that while the Products on SOLYPH.com are portrayed as accurately as possible, the colour and texture of the merchandise may differ depending on the accuracy of your monitor. Your monitor may not accurately depict the colour and texture of the merchandise. All material and information presented by SOLYPH.com is intended to be used for personal or informational purposes only. All Products available on SOLYPH.com, including any samples SOLYPH.com may provide to you, are for your personal use only. You may not sell or resell any Product you purchased or otherwise received from SOLYPH.com.

Local Delivery

Local delivery service is available for eligible residential and office addresses within Singapore and South Korea, except hotels and such other locations with restricted access. SOLYPH.com reserves the right to decline any delivery to any address with restricted access or is inaccessible. Refer to Shipping and Returns page for Shipment. There will be no delivery service on Sundays and Public Holidays or any blackout dates imposed by SOLYPH.com. SOLYPH.com endeavors to deliver within the date and time stipulated in the Order Confirmation. SOLYPH.com reserves the right to reschedule the time and/or date of delivery and will contact you to arrange an alternative delivery time and/or date. You are responsible for ensuring that a recipient is present to receive the delivery and to sign on SOLYPH.com assigned courier's delivery note during the specified time slot. You may be charged redelivery fee at the prevailing rate for each additional delivery trip. Should there be any unavailable items in the Order, SOLYPH.com will contact you for further arrangements. There will be a re-delivery charge at the prevailing rate imposed on you in case of any changes in delivery details after the delivery has been made or attempted.

International Delivery Information

International delivery service is available and will be shipped out from a local agent in South Korea. There will be International Delivery Charges depending on country of destination. Please note that international delivery service may be unavailable for certain products. Please email at hello@solyph.com to enquire further on Shipping and its Locations SOLYPH is able to ship to. Dispatch times may vary according to availability. Products to be delivered outside Singapore and South Korea (regionally) will be delivered by courier by SOLYPH.com’s designated logistics partner. Tracking reference number will be sent to you by email upon dispatch. The estimated delivery time taken is between 8 – 14 working days from the date of dispatch, and is subject to delay due to unforeseen circumstances. SOLYPH.com reserves the right to reschedule the time and/or date of delivery and will contact you to arrange an alternative delivery time and/or date. All international deliveries will be subject to the terms and conditions of delivery of [SOLYPH.com - Korea]’s designated logistics partner. SOLYPH.com’s designated logistics partner may impose charges for any attempts of redelivery.

Payments

SOLYPH.com accepts PayPal, GooglePay, ApplePay and all major credit and debit cards from Visa, Mastercard, American Express and Discover. Please note that mode of payment cannot be changed once you have submitted the order online.

Fraud Protection Policy

As part of our order processing procedures, we screen all received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order or our SOLYPH team may call you at the phone number you provided (or use your email address) to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.

Currency

All prices stated on SOLYPH.com are in US Dollars unless otherwise stated.

Return, Refund & Exchange Policy

SOLYPH.com is committed to providing you with quality products that meet your skincare needs. However, if you wish to request a refund or exchange for any purchased product if you experience skin sensitivities or if the product does not meet your reasonable expectations, please do so within 14 days upon receiving the product(s), in addition, with proof of skin sensitivities in order for us to assist in refunds or product replacement. 

Where a Product is defective, not of satisfactory quality or fitness for purpose, you may return the Product for an exchange or a refund of the amount paid for the Product without interest at the absolute discretion of SOLYPH.com, subject to the applicable law. Products must be returned with any free gift(s) and/or gift card(s) given with respect to the returned Product.

SOLYPH.com will not bear any shipping or postal charges incurred by customers during the process of return, exchange or refund of merchandise. SOLYPH.com may at its sole discretion reimburse any costs of return of defective Products incurred by you, provided that you submit to SOLYPH.com proof of such costs incurred.

You are required to contact SOLYPH.com at hello@solyph.com prior to any local or international returns and we will assist with the return process of providing the address and extra information. All refunds will be credited without interest into the same credit card that was used for the Order. If you obtain refund for any Products for which rebates have been credited, corresponding number of rebates for the Products returned will be deducted from your account.

Please note that it takes approximately 21 days for a credit return to your card to be effective. Please contact SOLYPH at hello@solyph.com if you have any queries about returns or exchanges. We will be happy to attend to you.

Merchandise Warranties

SOLYPH.com does not warrant that the quality of the Products purchased on SOLYPH.com will meet your needs or expectations after any form of misuse, abuse, product mishandling, misguided usage and deviation from printed instructions. Subject to the following clauses and to the fullest extent permitted by law, SOLYPH.com gives no warranty in respect of the Products. SOLYPH.com does not provide warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, satisfactory quality and/or fitness for a particular purpose, is given in conjunction with the Products sold on SOLYPH.com, subject to the applicable law.

No Warranties

All content included in or made available through SOLYPH.com and/or the Interactive Sites, including but not limited to information, communications, software, graphics, images, videos and sounds contained in SOLYPH.com and/or the Interactive Sites are provided on an " as is" and " as available" basis. Without prejudice to the foregoing, you agree that the Materials contained within or available through SOLYPH.com and/or the Interactive Sites may not be used for commercial purposes or distributed commercially. Trade Marks The trademarks, service marks, trade names and logos (""Trade Marks"") used or appearing on SOLYPH.com and/or the Interactive Sites are property of SOLYPH, its affiliates or third party licensors. Exclusion of Liability

In no event shall SOLYPH be liable to you or any person for any death, injury, direct, indirect, incidental, special, consequential, exemplary damages or other indirect damages or costs of any kind suffered or incurred by you of any kind, based upon a claim by a third party grounded in tort (including negligence), strict liability, breach of contract, breach of warranty or otherwise, as a result of or in connection with the use of SOLYPH.com and/or the sale of the Products at SOLYPH.com, even if SOLYPH have been advised on the possibility of such damages, subject to the applicable law. For the avoidance of doubt, SOLYPH shall in no event be liable for any death, injury, direct, indirect, incidental, special, consequential, exemplary damages or other indirect damages or costs of any kind suffered or incurred by you arising from or in connection with: any access, use or the inability to access or use SOLYPH.com and/or the Interactive Sites, or reliance on the Materials and/or any information contained in SOLYPH.com and/or the Interactive Sites; any unauthorized use of or access to your account; any mishandling and/or abuse of Product by you or other persons; use of Product by you or other persons in any manner, whether foreseeable or otherwise. The customer assumes all risks associated with product usage and storage upon delivery; any delay in delivery or cancellation of Order or refund; any system, server or connection failure, error, omission, interruption, delay in transmission, or computer virus; any use of or access to any other website linked to SOLYPH.com and/or the Interactive Sites, even if SOLYPH or its agents or employees are advised of the possibility of such damages, losses and/or expenses. Any hyperlinks to any other websites are not an endorsement of such websites and such websites should only be used or accessed at the site user's own risks. In no circumstances shall SOLYPH be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on the websites to which SOLYPH.com and/or the Interactive Sites are linked; any exercise of rights by SOLYPH.com under these Conditions, the Data Protection Policy and any other rights provided by law. This exclusion clause shall take effect to the fullest extent permitted by Singapore law. Without prejudice to Clauses 16.1, 16.2 and 16.3, SOLYPH's aggregate liability to you shall be limited to the purchase price of the Product paid by you.

Indemnity

You agree to indemnify and hold each of the SOLYPH, its subsidiaries and affiliates and their respective directors, officers, employees, suppliers, vendors, licensors, agents and any third party content providers harmless from any claims, demands, losses, damages or expenses (including legal fees), arising from, relating to and/or in connection with (a) your use of, or access or connection to SOLYPH.com and/or the Interactive Sites and/or the Material therein; and/or (b) your breach of any of these Conditions; (c) your violation of any law or the rights of a third party, including intellectual property infringement pertaining to any content which you post or transmit on or via SOLYPH.com and/or the Interactive Sites.

Reserved Rights

SOLYPH reserves all rights to deny or restrict access by any person to SOLYPH.com and/or the Interactive Sites, or to block access from a particular Internet address to SOLYPH.com and/or the Interactive Sites, at any time, for any reason whatsoever and without ascribing any reasons whatsoever. SOLYPH reserves the right to change, revise or modify any part of SOLYPH.com and/or the Interactive Sites at any time at its sole discretion without notice.

General Terms

Your access and/or use of SOLYPH.com and/or the Interactive Sites are subject to these Conditions. These Conditions shall be governed by and construed in accordance with the laws of Singapore and you agree to submit to the exclusive jurisdiction of the courts of Singapore. No delay or failure by SOLYPH to take any action or to enforce or exercise any of its rights in these Conditions will operate as a waiver of such rights by SOLYPH, nor will such failure or delay in any way prejudice or affect SOLYPH's rights at any time thereafter to act strictly in accordance with our rights in these Conditions. Any Conditions, or any part thereof, which is declared or adjudged to be illegal, invalid, prohibited or unenforceable under any applicable law in any jurisdiction shall be ineffective to the extent of such illegality, invalidity, prohibition or unenforceability without invalidating, vitiating or rendering unenforceable, the remaining Conditions, and any such illegality, invalidity, prohibition or unenforceability in any jurisdiction shall not invalidate, vitiate or render unenforceable any such Conditions in any other jurisdiction. These Conditions and any rights, obligations and licenses granted therein may not be assigned or transferred by you, but may be assigned or transferred by SOLYPH without restriction. These Conditions are for the benefit of SOLYPH and its directors, officers, employees, affiliates, suppliers, vendors, licensors, agents and any third party content providers to SOLYPH.com and/or the Interactive Sites. Each of these entities shall have the right to assert and enforce any of these provisions against you. Save as aforesaid, a person (including any user) who is not a party to this Agreement has no right to enforce any of these Conditions under the Contracts (Rights of Third Parties) Act (Cap 53B). The reference to a person, in this clause includes any individual, company, corporation, firm, partnership, joint venture, association, organization, trust, state or agency of a state (in each case, whether or not having separate legal personality).
